These Terms of Service ("Terms") govern your use of the MyMissedCall.com service ("Service"), operated by Fotheringham Family Management LLC ("Company," "we," "us," or "our"). By using the Service, you agree to these Terms.

1. Description of Service

MyMissedCall.com provides an automated SMS response service that sends text messages to callers who reach a business phone number and do not connect with a live person. The Service uses artificial intelligence to engage callers via SMS on behalf of registered businesses ("Clients").

2. Eligibility

You must be at least 18 years old and operating a legitimate business to use this Service. By registering, you represent that all information you provide is accurate and that you are authorized to bind your business to these Terms.

3. Messaging and SMS Communications

The Service sends SMS messages to individuals who have initiated contact with your business by placing a phone call.
You are responsible for ensuring your use of the Service complies with all applicable laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and applicable state laws.
You must not use the Service to send unsolicited commercial messages, spam, or messages to individuals who have opted out.
Message and data rates may apply to end recipients based on their mobile carrier plans.
You may reply STOP to any message to opt out of future communications.

4. Opt-Out and Consent

Recipients may opt out of further SMS communications at any time by replying STOP. The Company will honor all opt-out requests promptly and in compliance with carrier requirements.

5. Prohibited Uses

Send messages that are illegal, threatening, harassing, defamatory, or fraudulent
Impersonate any person or business
Transmit spam or bulk unsolicited messages
Violate any applicable federal, state, or local law or regulation

6. Fees and Payment

Service fees are billed monthly in advance. All fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days' written notice.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOTHERINGHAM FAMILY MANAGEMENT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED FEES PAID IN THE THREE MONTHS PRECEDING THE CLAIM.

9. Governing Law

These Terms are governed by the laws of the State of Utah. Disputes shall be resolved in the courts of Salt Lake County, Utah.

3. SMS Data and Messaging

Phone numbers and SMS data are used solely to deliver the missed-call response service. We do not sell, rent, or share end-user phone numbers or message content with third parties for marketing purposes.

4. Sharing of Information

Twilio Inc. — SMS delivery infrastructure provider
Payment processors — to facilitate billing
Legal authorities — when required by law

We do not sell personal information to third parties.

5. Opt-Out Rights

End users may opt out at any time by replying STOP. Requests are processed immediately.

6. Data Retention

Client data retained up to 12 months post-termination. SMS conversation data retained up to 90 days.
