These Terms of Service ("Terms") govern your use of the MyMissedCall.com service ("Service"), operated by Fotheringham Family Management LLC ("Company," "we," "us," or "our"). By using the Service, you agree to these Terms.
MyMissedCall.com provides an automated SMS response service that sends text messages to callers who reach a business phone number and do not connect with a live person. The Service uses artificial intelligence to engage callers via SMS on behalf of registered businesses ("Clients").
You must be at least 18 years old and operating a legitimate business to use this Service. By registering, you represent that all information you provide is accurate and that you are authorized to bind your business to these Terms.
Recipients may opt out of further SMS communications at any time by replying STOP. The Company will honor all opt-out requests promptly and in compliance with carrier requirements.
As a Client, you are solely responsible for the content of customized messages sent through the Service and ensuring proper disclosure to customers that they may receive automated text messages.
Service fees are billed monthly in advance. All fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days' written notice.
All software, AI models, interfaces, and content comprising the Service are owned by Fotheringham Family Management LLC or its licensors.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOTHERINGHAM FAMILY MANAGEMENT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED FEES PAID IN THE THREE MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Fotheringham Family Management LLC from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
Either party may terminate the Service with 30 days' written notice. We reserve the right to suspend accounts immediately for violations of these Terms.
These Terms are governed by the laws of the State of Utah. Disputes shall be resolved in the courts of Salt Lake County, Utah.

This Privacy Policy describes how Fotheringham Family Management LLC collects, uses, and shares information when you use MyMissedCall.com ("Service").
From Clients: Business name, address, contact information, billing information, registered phone numbers, and account preferences.
From End Users (Callers): Phone number, SMS conversation content, and message timestamps.
Phone numbers and SMS data are used solely to deliver the missed-call response service. We do not sell, rent, or share end-user phone numbers or message content with third parties for marketing purposes.
We do not sell personal information to third parties.
End users may opt out at any time by replying STOP. Requests are processed immediately.
We implement reasonable technical and organizational measures to protect information. No internet transmission is 100% secure.
Client data is retained for up to 12 months after termination. SMS conversation data is retained for up to 90 days.
The Service is not directed to individuals under 18. We do not knowingly collect information from minors.
